Daniel Tosh and Rape

By Liberate Zealot
Content Warning - Rape
Lovely, and not too surprising considering an episode of his TV show I saw last summer. It was one of the few times I’ve watched and in it Tosh showed a video of a “dildo fight” that turned into a rape.
He made jokes about the video. This man showed a video of a teen boy being rape by his friend with a dildo for entertainment purposes.  He made jokes about it.
A description of the video is bellow the cut.  I removed the embedding because they're teens and it might be child porn and illegal.  It's up on Youtube. Again, it’s likely triggering.

A white teen boy in jeans and a green and orange shirt stands outside a house, holding a large, dark colored dildo.  Another white teen boy, in jeans and a white t shirt opens to door and starts to step out.  The first teenager starts hitting the second boy with the dildo. The second boy starts to fight his friend off and chases him onto the yard.  Laughs and comments from several other teen boys are heard behind the camera. The second boy knocks the dildo from the first teen’s hand, grabs him, and throws him on the ground. He starts to climb on top of the back of the first boy, and they both fall back on the ground.  The first boy picks up the dildo again and returns to hitting the second boy, who is behind and slightly under the first.
The first boy flips the second around, so that he is now resting all his weight on his neck and shoulders, with his bottom in the air.  The first teen hits the second with the dildo several times on his bottom, before pulling down the second boys pants, baring his ass, and hitting him with the dildo again. The second boy tried to cover his bottom.  The other teen boys can be heard laughing still.  One of them shouts “Put it in”.  The first boy changes his grip on the dildo and shoves it at and into the second boys rectum multiple times.  He then gets up and throws the dildo at the second boy who continues to lie on the ground.  The camera spans around to show a half dozen other teen boys who are laughing.  The second boy, who was assaulted, lies on the ground and covers his face. A teen boy in a hoodie runs up to high five the first boy, who just rape/sexually assaulted another boy. One teen says “That was so beautiful” and the camera again shows everyone, but the second boy, laughing.  Finally the second boy sits up and says “That was awful, and you got it all on camera.”  And the video ends.

UPDATED 7/13/12 - Tumblr clued me into the fact that Tosh's commentary on this video is also incredibly racist.  I'm ashamed I didn't catch the immediately/remember it. I'm not currently up to viewing that video again to post of transcript of Tosh's commentary.  The link is available for those who feel up to viewing it.  But here are the tags on the Tosh.0 page for the video. Some are visible in the screen grab.

Updated 7/14/12: Positive Connotation of tumblr did a transcript of Tosh's commentary:

Two teenage boys and a massive sex toy. That’s either a party at Bradley Cooper’s house or this week’s breakdown. (laughter) Don’t you hate it when there’s a knock at the door and you end up getting slapped with a rubber dong? At least it’s not a Jehova’s Witness. (laughter) That is a giant black dildo. Or, as black people call it, an average black dildo. (laughter) How humiliating. You don’t know where that black mamba has been. (laughter) Well, you kind of do. It smells like mom. (laughter) Alright, never get separated from your piece. That’s a dil-don’t. (laughter) But just when you thought it couldn’t get any more homoerotic. I’d be happy to tag in any time. (laughter) Whenever I see someone grip a wiener like that, it’s a safe bet I’m going to like what comes next. (laughter) NO LUBE? A true friend would spit on it before he started rammin’. (laughter) And now you know what prison is like. (laughter) I wonder if that’s how he thought he’d lose his virginity? (laughter) The line between prank and rape is getting pretty blurry right now. (laughter) Hey pal, choke up on that thing and even out those strokes or he’s never going to finish. (laughter) It’s better to give than to receive. And that definitely seems true when it comes to being sodomized by your best friend on the front lawn. (laughter) But hey, that’s just dudes being dudes. Now let’s never speak of this again. And for that, we thank you.

Warning for Comments: While we are not allowing the worst comments to post, we are letting comments that disagree with the analysis of the video.  Some of these comments include rape apologia.  Other comments include people discussing the rapes and assaults that they endured.

See here for possible actions you can take against Tosh and Comedy Central.

  1. This is horrific, and points out that Tosh is not limited to joking about and laughing at fictional rape; he finds an actual incidence of filmed rape (between under-18s, no less) to be worth showing on TV and laughing at.

  2. Absolutely horrible. Thank you for sharing this. More reason to get him off air.

  3. Just Updated after going through the Tosh.0 archive to find proof that the video was shown. There's a screen grab in another post on this blog, and a link to the Tosh.0 web-page and the clip with Tosh commenting on it.

  4. Unfortunately, you have no idea what the second boy who was supposedly "raped" actually thought of the whole ordeal.

Are you 100% sure it actually emotionally destroyed him and he considers it to be some terrible form of rape, like you so absolutely believe it was?

I've had friends come up to me a grab my privates, slap my butt, squeeze my boobs, etc. But you know what? They're my friends, and it doesn't bother me because I know they're not being aggressive. For all you know, this didn't bother the kid at all. So what it he wasn't laughing? Sometimes I don't laugh, but does that mean it bothers me?

He's a teenage boy. Quit trying to speak his mind for him. You don't know what he thought. You're an egotistical feminist, he's a goofball teenage boy. You two have completely different perspectives on whats funny and whats not.

And fuck you with all your fucking feminist anti-Daniel Tosh bullshit, too. He's fucking hilarious and you just have to live with the fact that your opinion isn't the only one that matters.

It had never even occurred to me that this video was rape because I was too busy focusing on the fact that it's 2 teenage boys doing the dumb, immature things that teenage boys do. YOU should be ashamed that all you can think about is boys getting raped in a situation that you obviously have no background knowledge about.

    1. This makes me sick to my stomach. Completely sick. No we don't have the boy's opinion on this. But the fact that you'd assume that he was okay with it is even more sickening. The fact that you could write it off as boys being boys is horrifying. There's a huge different between some slaps on the butt between friends and what happened in this video! And the fact that you would defend it is EXACTLY the reason why this is NOT funny!

    4. You almost had a point and then you veered off into stupid bullshit territory. Apparently our opinions aren't the only ones that matter but yours is? How do you figure that?

    6. It's possible that all people involved were consenting adults. But this video suggests that this was not the case. Now, they could be actors presenting a fictional rape scene, but Tosh presented it as an actual assault and presented it as something to laugh at, and laugh at the victim no less.

Even if all involved in the video were consenting adults, and assuming that Tosh knew this, the way he presented it shows Tosh to be a fucking asshole.

Sorry. Consent might excuse the people in the video, but it in no way excuses Tosh here.

    8. So let me know how good it feels next time your friends tape you getting a dildo shoved up your ass. Maybe that's just what your friends do though right? And that makes it okay? There is a huge difference between the contact you discribed and the contact those boys had. The boy was obviously ashamed. But hey, if you want to show yourself being anally penatrated to millions of people then please stop letting your sick fetishes cloud your perception. Unlike you and your friends, most people don't like being sexually harrrassed or raped.
Also, you obviously have less background knowledge of this case as well as that of what counts as feminism and rape. He didn't laugh with the others, so it seems that he and the author of this post had the same idea of what was humorous.

    9. The guy had a dildo shoved up his ass.

I'm sure if your friends suddenly decided to pin you down and stick part of their anatomy or a foreign object inside of you you wouldn't be too happy.

You're an idiot. Everything up until the insertion of the dildo could be considered horseplay. But when the dildo was inserted? Nope. That is not ok at all.

    10. I once had a girl hold a knife to my throat and shove coffee down my mouth. While I'm sure Tosh would find it funny to watch a 12 year old me choke and splutter, it wasn't fun or funny to me, it was terrifying.

Once, I had a bunch of my guy friends hold me down and 'pretend' to rape me. Everyone was laughing then too, except me. I had to play it off like I was okay with it or I would have been called a stuck up bitch or incapable of handling a joke, even though I was scared shitless.

Sometimes, kids go too far. Sometimes, what everyone else thinks is funny isn't funny to the person it's happening to. The boy in the video at the end is covering his face and rolling around. He's not laughing and going "Haha! You got me!" he's clearly unhappy with the turn of events.

Using the justification of "They're just boys, they're just playing around." only goes so far. Even Tosh commented that there was a line being drawn between a prank and rape there and it was. The moment that kid pulled the other boy's pants down and exposed his ass (and asshole) to the world was the moment the prank went too far. Kids can be mean spirited, and what happened was a mean spirited prank meant to hurt and really humiliate that kid. And they succeeded.

And yet you don't seem to realize that that goes both ways, considering your entire rant was all about you being butthurt that someone doesn't think Tosh is funny.

  5. Stink-182, I'm sorry that you have zero empathy for teenaged boys and for their rights to bodily autonomy. Boys and men can be raped, too, and your gaslighting does nothing to make them safer, or to enable them to seek assistance after they've been assaulted.

If you think that raping someone with an object is something that teenaged boys just do, then you have a seriously distorted notion of appropriate behaviour and boundaries.

  6. It's true I don't know the feelings of the boy in question. But I do know what I saw. At the very least it's legally sexual assault, depending on the area it happened in it's rape. That's fact. I don't know the ages of the teens in question or the age of consent where they are. But legally shoving anything into a person's vagina or anus is rape. The comments of the other teens and the grip of the boy holding the dildo show penetration was their intent. They committed a serious crime. Daniel Tosh showed it for entertainment purposes, and if the survivor of the sexual violence is under 18 than he distributed child pornography.

  9. okay, so i watched this "dildo rape" video. and being a teen myself i can understand the inane male teen behaviour. from what i can see, it was a joke that went out of hand. to be honest, the boy wasnt "raped" there was absolutely no penetration of any orifice. ALTHOUGH, i'm sure that the boy was scared out of his socks. i would also like to comment on how this article said the 'victim' wasn't laughing. My assumption is because 1: he was just attacked by a giant black dildo, 2: his friend faked anal penetration and 3: he was just laying on his neck, and that shit hurts.

Wow, being a male teenager doesn't mean your behaviour should include attempting to rape your friends.

  10. Seriously? Did you even watch the video? That was NOT raped. Have you ever been raped? Talk to someone that has and get back to me on that one. Not going to tell you my story, but that was not rape. Clearly you have not ever had or witnessed vaginal or anal penetration, because in order to do so, the vagina or anus needs to be penetrated. Doesn't look at all like the 'dildo' ever really enters the anus. Technically, not rape.

I will not argue with you on whether or not that was sexual abuse and harassment, though. It really doesn't seem as though the victim was very upset at all, however none of us know how that boy really feels.

Honestly, I really am offended you are using the term rape to describe that video. Rape is a very strong word in which you will never know the meaning of until it's actually happened to you or someone you love.

  12. You realize there is no penetration, right? He slaps they very floppy dildo against his friends crack. You anus is very tight muscle because, if it wasn't, your waste would just fall out of your body. Things just don't slip in, especially if they have no structure to them and they're floppy. If this kid felt in danger of being raped, the muscle would also clench tightly, making it almost impossible for someone slapping a rubbery piece of silicone against it to actually penetrate it. Most of the time, he's not even hitting where the kid's anus would be. The tip of the dildo even bends into view and doesn't go anywhere inside the kid's ass.

And, if this was penetration of any kind, the station would pull it for ratings since it would be considered NC-17, regardless if these two were adults. You do realize that a nip-slip will blow up the fucking news, do you really think that anal penetration by two males would be allowed? I highly doubt it.

These kids also don't look like teenagers and they look like close friends. The "victim" could have bucked his friend off, no doubt, and if he was being raped or if there was actual penetration of any kind, I'm sure at least one of they many guys who are around would have jumped in and stopped it. The kid would also be in a lot of pain if something that big was forced in his anus. Hell, I've heard a trip to the doc's office for a rectal exam, complete with lube and a skilled doctor, is very uncomfortable...

I've watched that scene a few times and there is no doubt in my mind that there is no penetration. Also, if what you are claiming was, in fact, true, this is video evidence of rape. You can see the guy's faces and who was doing what. All of these men would be brought up on charges if the "victim" wanted.

My point is, you are not even paying attention to the video, just assuming you know that this kid was raped. There are too many factors against your argument to state otherwise. Tosh.0 does not control the station he's on or his show 100%. There were many other players in this, not just him, so blaming him is a little stupid for an entire network and learn a little more about human anatomy for fucks sake.

  14. In the description it says it entered his rectum... But I was watching closely for that as I was expecting real rape, and it definitely did not. It wouldn't have been able to, not without some spreading and lubing involved. The anus isn't really meant to have things go into it so the body makes it difficult. All the dildo did was slap his ass, and maybe poke it a bit, but definitely did *not* enter.

And I'm also not sure why you people are claiming it's so "obvious" that it was non consensual. I'm not saying it was consensual, not at all, I'm just saying you guys are assuming a lot and then calling it absolute. I think you should try to contact the people in the video before going forth about this.

If these kids knew their friend didn't like it and feared retribution for committing something illegal, do you think it would have ended up on youtube in the first place? I don't think six people wouldn't have come up with some sort of objection if there was actually something wrong with the situation.

Daniel Tosh is a douchebag, that's not a question. But he has a pretty big audience. Best of luck to you getting rid of him.

    1. You have GOT to be joking. Please, do tell me more about what real anal rape is like. Tell me more about how people are anally raped and how it must include spreading and lubing. Tell me more about how these boys surely must know that after all, people are always justly punished for sexual assault, so they must not have done it or they'd be afraid to post such a video. Sure. Because it's ALWAYS recognized and ALWAYS punished, right? Except for when it's not, which is damn near most of the time. Case in point: YOUR OWN COMMENTARY.

    2. Shereva, teen boys like that tend not to have "friends" in the traditional sense. They tend not to have people in whom they can confide, for instance. They tend to view the concept of "confiding" as "totally gay". They tend to view raping other boys as "totally sweet". So there's your first mistake: assuming that the boys in this video are friends and that consent was even an option.

  16. Okay I understand the outrage about the rape part, but incredibly racist? Seriously? Black people have, on average, bigger penises than other races. I don't understand how something, backed by fact, can be racist. In fact it is not racist at all and I can't believe anyone would be offended by that.

When you characterize that video as "incredibly racist", I feel that it weakens your points addressing his offensive jokes on rape. This is because it looks like you're looking for a reason to get offended. You would strengthen this post by removing the "race" part altogether.

    1. "Black people have, on average, bigger penises than other races."

Um. No, actually. That is called "The Black Penis Myth", and it is a racial stereotype that is incredibly destructive to black sexuality. In fact, it is very racist. Do a google search and educate yourself.

And by the way, there's this little thing called intersectional oppression, and pointing out its presence in Tosh's video doesn't weaken any arguments made here at all, in fact, it just further proves that he is a privileged, ignorant, oppressive shitbag.

  17. like the biggest acheivement of the black race is having large dicks?! How can you NOT see that is racist and damaging? Just like women want to be taken seriously and not have their tits spoken about all the time. Black people deserve to have their proper acheivements celebrated and not be reduced to a punchline of a crap joke.

  18. I wish I could say I was amazed at the rape apologia comments. But unfortunately I've spent to much time discussing rape to have expected anything else. Honestly I'm just happy we haven't received any rape threats / wishes. Especially since we know Tish condones rape a threat as a means to silence people.
As for the comments themselves, my love for absurdity is provoked by people attempting to explain this rape away because "it's a prank, boys will be boys" while the next rape apologist casts them as grown men, who thought this through, planned it, and obviously it was staged and consrnsual. Two sides of the same rape culture coin.
As for everyone discussing how much penetration has to happen for this to be rape, you're disgusting and should be ashamed of yourselves.

Also calling out racist stereotypes does not deminish the rape or Town's actions in anyway. If anything it shows how hateful he really is.

  19. Also for those who've enquired, yes I'm a survivor of rape. It was a rape that any rape apologist would have said wasn't a rape. It took me nearly a year to name the sexuality violence tor what it was, rape (before than I used sexuality assault. As many are doing in this instance).

  20. I can't get over the video description: "dildo fight." Because a dildo fight--two people squaring off against each other with big floppy dildos-- would have actually been funny.

  22. Just because it wasn't rape doesn't mean it wasn't sexual abuse/assault.
Just because I was molested and not raped as a child, doesn't mean it wasn't fucking damaging and painful to get through.
    No.
Fuck you to those saying, because legally it isn't rape, it's okay and it should be dismissed.
